Allotments of tourist developments

Tourism planning

Turismo de Portugal is responsible for issuing an opinion on allotment operations which include the installation of tourist developments, within 20 working days. When allotment operations are located in an area covered by an overall plan in which Turismo de Portugal has been involved, there is no need to issue a new opinion.

Allotment operations are the actions that have as their object or effect the constitution of one or more lots projected immediately or subsequently to urban construction, and that result from the division of one or more buildings, or their reparcelling (subparagraph i) of Article 2 of the RJUE - Regime jurídico da urbanização e edificação [Legal regime of urbanisation and building] - Decree-Law no. 555/99, of 16 December, as amended by Decree-Law no. 136/2014, of 9 September).

It is the responsibility of Turismo de Portugal to issue a mandatory opinion on allotment operations which contemplate the installation of tourist developments (Article 21 of RJET - Regime jurídico dos empreendimentos turísticos [Legal regime of tourist establishments] - Decree-Law no. 39/2008, of 7 March, as amended by Decree-Law no. 80/2017, of 30 June), including those whose classification is the responsibility of the corresponding City Council (Housing Tourism, Country Houses, Agrotourism or Camping and Caravan Parks).

The general rule laid down in Article no. 41 of RJUE does not apply to allotment operations of tourist resorts, where it is established that allotment operations may only take place in areas within the urban perimeter and on land that has already been developed or whose development is programmed in a municipal or intermunicipal land development plan.

In other words, there may be land allotment operations on rural land provided that the tourist use is compatible with the provisions of valid and effective territorial management instruments (Article no. 38 of RJEU).

Instruction of allotment operations processes - Prior Information Request (PIP), Licensing and Prior Notification

The instruction of the Prior Information Request, Licensing or Prior Notification processes of allotment operations that contemplate the installation of tourist developments must comply with the following diplomas:

- Decree Order no. 113/2015, of 22 April, which identifies the instructional elements of the procedures provided for in the Legal regime on urbanization and building (RJUE);

- Decree Order no. 518/2008, of 25 June, which establishes the instructive elements for requests to carry out urbanistic operations related to tourist developments.

In accordance with Article 13-B of RJUE (prior consultation), the interested party may apply directly to Turismo de Portugal Board for an opinion. If you choose to use this procedure, you can make your request to this Institute, by submitting a request accompanied by the appropriate instructional elements. The application must be submitted in digital format through the Information System of the Legal Regime of Tourist Enterprises (SI-RJET) (Allotments).
The technical drawings should be sent in dwg format.

In case of difficulty regarding the submission of the elements on that platform, submit them through: dvo.deot@turismodeportugal.pt.
